Terms and Conditions

These terms apply when you visit or use the Awareness Work website, and any pages, forms, online platforms or digital materials we provide through it (the “Website”). By using the Website you agree to these terms. If you do not agree, please do not use the Website.

  1. About us

1.1        The Website is operated by Awareness Work Pty Ltd (ACN 668 150 034) as trustee for the Awareness Work Trust (ABN 48 706 495 157), of 204/50 Jenner Street, Little Bay NSW 2036. In these terms, “Awareness Work”, “we”, “us” and “our” mean that entity.

1.2        You can contact us at [email protected].

  1. What we offer

2.1        Awareness Work offers online group therapy and personal development programs, including The 6 Month Therapy Course by Awareness Work and related programs, as well as one-on-one therapy sessions delivered by Zoom or phone.

2.2       Information on the Website describes what we offer and is general in nature.

2.3       Enrolling in a program or booking one-on-one therapy is subject to a separate agreement, including an informed consent, which you will be asked to read and accept before you begin. If there is any inconsistency between these terms and that agreement, the agreement applies to that program or service.

2.4       Your acceptance of each agreement or consent, including the date and time, is recorded in our systems.

  1. The Website does not provide therapy

3.1        The content on the Website, including written pages, blog posts, videos, audio, social media content and free resources, is general information and education. It is not therapy, counselling, or medical or mental health advice, and it does not replace professional care.

3.2       Visiting the Website, subscribing to our emails or contacting us does not create a therapist and client relationship. That relationship begins only after you have completed our intake and consent process and we have confirmed in writing that you are a client or program participant.

3.3       Our work is not suitable for everyone. If we consider that a program or service is not suitable for you, we will tell you and discuss other options where we can.

  1. If you are in crisis

4.1       The Website, our contact forms and our email inbox are not monitored for emergencies and are not a crisis service.

4.2       If you or someone else is at immediate risk, please call 000. You can also contact Lifeline on 13 11 14 or the Suicide Call Back Service on 1300 659 467 at any time.

  1. Outcomes and individual experience

5.1        Therapy and personal development work can support greater self-awareness, and people may notice changes in how they relate to themselves and others. Experiences vary from person to person.

5.2       We do not promise or guarantee any particular result. Stories, testimonials and examples on the Website describe individual experiences and may not reflect what you will experience.

5.3       We publish testimonials from program participants only. We do not publish testimonials from one-on-one therapy clients.

5.4       We invite testimonials only after a program has finished. A testimonial can be signed with your name or shared anonymously. Providing a testimonial means you agree to us using it for marketing, including on the Website, on social media and in promotional material.

5.5       Choosing not to write a testimonial, or withdrawing one you have given, has no effect on your care, fees or standing. You can withdraw your consent at any time by emailing [email protected].

  1. Professional standards

6.1       Awareness Work is a non-registered health practitioner service operating under the NSW Code of Conduct for Non-Registered Health Practitioners (Public Health Act 2010 (NSW)). Our work is also guided by the Australian Counselling Association (ACA) Code of Ethics and Practice and the applicable ACA scope of practice.

6.2       Our lead therapists are trained and qualified psychotherapists and counsellors. They are not registered psychologists.

6.3       Information about qualifications and experience on the Website is provided in good faith and was accurate when published.

  1. Fees, deposits, payment and refunds

7.1       Prices on the Website are shown in Australian dollars and include GST. Fees for each program or service are confirmed at enrolment or booking.

7.2       Payment plans are offered at our discretion, on request, as set out in your Program Agreement.

7.3       Where a program has a deposit, the deposit secures your place and is non-refundable.

7.4      Program fees are not refundable once invoiced. In cases of genuine hardship, we may consider a request to waive or reduce outstanding fees, as set out in our Program Fees, Deposits and Refund Policy and in your Program Agreement. If your signed Program Agreement differs from these terms, the Program Agreement applies.

7.5       Fees and cancellation terms for one-on-one therapy sessions are set out in your Individual Therapy Informed Consent and Client Agreement.

7.6       We use third-party platforms and payment providers to take payments. Their terms and privacy practices apply to those transactions.

7.7       Nothing in this section limits any right you have under the Australian Consumer Law.

  1. Using the Website

8.1       You agree to use the Website lawfully and respectfully. You must not:

8.2       Program sessions, group spaces and materials are for enrolled participants only. You must not record, screenshot, share or distribute any session, group discussion, participant information or program material without our written permission. Participants in group programs are asked to keep what other participants share confidential.

  1. Accounts and access

9.1       If you are given a login to a members area or program platform, you are responsible for keeping it secure and for activity under your account. Access is personal to you and cannot be shared or transferred.

9.2       We may suspend or end your access if you breach these terms, or if your participation appears unsafe for you or for others.

10.1      All content on the Website and in our programs is owned by or licensed to Awareness Work and is protected by copyright and other intellectual property laws. This includes course materials, session formats, methodology, worksheets, written content, audio, video, graphics, logos, branding and names, including “Awareness Work” and “The 6 Month Therapy Course by Awareness Work”. (b)     present our content, methodology or session formats as your own;

(c)     teach, facilitate or deliver Awareness Work programs or methodology to others; or

  1. Privacy and your information

11.1       We handle personal information in line with the Privacy Act 1988 (Cth), the Australian Privacy Principles and, for health information, the Health Records and Information Privacy Act 2002 (NSW). Our Privacy Policy, available at www.awarenesswork.com/privacy-policy, explains what we collect, how we use it and how you can access or correct it.

11.2      The Website uses cookies and similar technologies, which may include analytics and advertising tools. You can accept or decline non-essential cookies using the cookie notice, and you can change your browser settings at any time.

11.3      Please do not send sensitive personal or health information through Website contact forms or general email unless we have invited you to. Email and online communication are not completely secure.

11.4      Confidentiality of therapy and clinical records is covered by your informed consent and agreement with us, including the limits of confidentiality set by law.

  1. Email and marketing communications

12.1      When you subscribe to our emails, download a free resource or register for an event, you agree to receive emails from us. Each email identifies Awareness Work as the sender and includes a way to unsubscribe.

12.2      You can unsubscribe at any time using the link in any email, or by emailing [email protected]. We will stop sending you marketing emails promptly, and within five business days.

  1. Third-party platforms and links

13.1      We deliver our programs and communicate with participants using third-party platforms and services, which may include Kajabi, Zoom, Telegram, WhatsApp, Cliniko and Google Workspace. Their terms and privacy policies apply to your use of them.

13.2      The Website may link to other websites. A link is not an endorsement, and we are not responsible for the content, availability or practices of any third-party site or platform.

  1. Disclaimers

14.1      The Website and its content are provided on an “as is” basis. We take care to keep information accurate and current, but we do not warrant that it is complete or error-free, or that the Website will be available without interruption.

14.2     You use the information on the Website at your own discretion. Please do not disregard or delay seeking professional medical, psychological or other advice because of something you have read or seen on the Website.

14.3     Therapy and personal development work can bring up difficult thoughts, feelings and memories. You are responsible for the decisions you make about your participation and for looking after yourself during your involvement, and you can pause or stop at any time.

  1. Australian Consumer Law

15.1      Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by law, including under the Competition and Consumer Act 2010 (Cth), that cannot lawfully be excluded, restricted or modified.

15.2      Where a consumer guarantee applies to services we supply and it is lawful to do so, our liability for failing to comply with it is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

  1. Limitation of liability

16.1      To the extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the Website; your reliance on its content; the acts or omissions of third-party platforms or providers; or any interruption, error or loss of data.

16.2     To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, income, opportunity or data.

16.3      To the extent permitted by law, our total liability to you in connection with the Website or any program or service is limited to the fees you paid to us for the relevant program or service.

16.4     Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law.

16.5      Awareness Work Pty Ltd enters into these terms only in its capacity as trustee of the Awareness Work Trust. To the extent permitted by law, its liability is limited to the extent to which it is able to be satisfied out of the assets of that trust.

  1. Indemnity

17.1      To the extent permitted by law, you agree to compensate us for any loss, damage or cost we incur because you breached these terms, used the Website unlawfully, or infringed the rights of another person.

  1. Suspension and ending access

18.1      We may restrict, suspend or end your access to the Website, a program or a platform if you breach these terms, or if your conduct is abusive, unsafe or unlawful.

18.2     Sections about intellectual property, confidentiality, disclaimers, liability, indemnity and governing law continue to apply after your access ends.

  1. Changes to these terms

19.1      We may update these terms from time to time. The current version is the one published on the Website, and it applies from the time it is published. By continuing to use the Website after an update, you accept the updated terms.

19.2     Changes to these terms do not alter the agreement you have signed for a program or one-on-one therapy.

  1. General

20.1     These terms, together with our Privacy Policy, our Program Fees, Deposits and Refund Policy and any program or therapy agreement you have with us, are the entire agreement between you and us about your use of the Website.

20.2     If any part of these terms is found to be invalid or unenforceable, the rest continues to apply.

20.3     If we do not enforce a right straight away, we have not given it up.

20.4    You may not transfer your rights under these terms. We may transfer ours to a successor of the business.

20.5     We may give you notices by email or by posting them on the Website.

  1. Governing law and disputes

21.1      These terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them. Any legal proceedings arising from or connected with these terms, the Website, or any program or service must be brought and dealt with in New South Wales.

21.2      If a dispute arises, the person raising it must first tell the other in writing what the dispute is and what outcome they would like. Both will make every effort to resolve it by negotiation within 14 business days. If it is not resolved, it will be submitted to mediation before any court proceedings begin, except where a person seeks urgent interlocutory relief.

21.3      Nothing in this section limits or delays your right to complain to the NSW Health Care Complaints Commission (1800 043 159, www.hccc.nsw.gov.au), or to any other regulator or authority, at any time.
